Terms of Service

1. Acceptance of Terms

By accessing or using the Katoads platform (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms constitute a legally binding agreement between you ("User", "you") and Katoads SAS ("Katoads", "we", "us"). By creating an account, you confirm that you are at least 18 years old and have the legal capacity to enter into this agreement.

2. Service Description

Katoads is a SaaS platform that generates AI-powered advertising creatives for e-commerce products. The Service includes:

• AI-powered image generation for advertising creatives using generative AI models
• AI-powered video generation for short-form ad content
• Product analysis and marketing copy generation in 6 languages (EN, FR, ES, DE, IT, PT)
• Brand template management with logo, color, and font overlays
• Interactive layout editor for post-generation customization

3. User Account

To use the Service, you must create an account. You are responsible for:

• Providing accurate and complete registration information
• Maintaining the confidentiality of your login credentials
• All activity that occurs under your account
• Notifying Katoads immediately of any unauthorized use of your account

4. Subscriptions & Credits

The Service operates on a credit-based system with the following tiers:

• FREE: 10 one-time credits. TESTER: 50 one-time credits. STARTER: 300 credits/month. PRO: 800 credits/month. ELITE: 2,000 credits/month.
• Monthly credits reset at the beginning of each billing cycle. Unused monthly credits do not roll over.
• Purchased credit add-ons (250 or 500 credits) are preserved across tier changes, cancellations, and monthly resets.
• All tiers consume credits per generation — there is no unlimited access tier.

5. Acceptable Use Policy

You agree not to use the Service to:

• Generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Create misleading or deceptive advertising content that violates applicable advertising regulations
• Infringe upon intellectual property rights of third parties, including trademarks and copyrights
• Attempt to reverse-engineer, decompile, or disassemble any part of the Service or its AI models
• Use automated bots, scrapers, or other unauthorized means to access the Service

6. Intellectual Property & AI-Generated Content

The Katoads platform, including its software, design, algorithms, and documentation, is the exclusive property of Katoads SAS and is protected by French and international intellectual property laws. You may not copy, modify, or distribute any part of the platform.

Regarding AI-generated content: you retain usage rights over creatives generated through the Service for your commercial advertising purposes. However, AI-generated content may not be eligible for copyright protection under applicable law. Katoads does not claim ownership of AI-generated outputs but makes no warranty as to their protectability. You are solely responsible for ensuring your use of generated content complies with applicable laws and third-party rights.

7. Service Availability

Katoads strives to maintain 99.9% uptime but does not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will endeavor to notify users of planned maintenance in advance. Katoads shall not be liable for any loss resulting from service interruptions.

8. Limitation of Liability

To the maximum extent permitted by law, Katoads shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service. Our total liability for any claim arising from these Terms shall not exceed the amount you paid to Katoads in the 12 months preceding the claim. This limitation does not apply to damages caused by Katoads' gross negligence or willful misconduct.

9. Termination

Either party may terminate this agreement at any time. You may close your account via your account settings or by contacting support. Katoads may suspend or terminate your account immediately if you breach these Terms. Upon termination, your right to use the Service ceases immediately. You may request export of your data within 30 days of termination (see our Data Portability policy). After this period, your data will be deleted in accordance with our Privacy Policy.

10. Modifications to Terms

Katoads reserves the right to modify these Terms at any time. We will notify users of material changes via email or in-app notification at least 30 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the modified Terms. If you do not agree with the changes, you must stop using the Service and close your account.

11. Governing Law & Dispute Resolution

These Terms are governed by French law. For consumer users within the EU, mandatory consumer protection provisions of your country of residence also apply. Any dispute shall first be subject to an attempt at amicable resolution. If unresolved, disputes shall be submitted to the competent courts of Paris, France, subject to any mandatory jurisdiction rules applicable to EU consumers.
