Data Portability & Reversibility

1. Introduction

In compliance with the General Data Protection Regulation (GDPR, Article 20) and the EU Data Act (Regulation (EU) 2023/2854), Katoads is committed to ensuring that your data remains accessible, portable, and retrievable at all times. This document describes your rights regarding data portability, the formats available for data export, the reversibility guarantees we provide, and the process for switching services.

2. Right to Data Portability

You have the right to receive your personal data and service-generated data in a structured, commonly used, and machine-readable format. The following data categories are available for export:

• User profile: name, email, preferences, language settings, subscription history
• Generated content: all AI-generated images, videos, and associated metadata (prompts, styles, platforms, generation parameters)
• Brands & products: all brand configurations, product data, analysis results, and uploaded images
• Brand templates: logo files, color palettes, font configurations, placement rules, overlay settings
• Billing history: invoices and payment records (via Stripe customer portal)

4. How to Request Data Export

1. Send an email to contact@katoads.com with the subject line "Data Export Request" and specify which data categories you wish to export.
2. We will verify your identity within 2 business days to protect against unauthorized access.
3. Your data export will be prepared and made available for secure download within 15 business days of identity verification.
4. You will receive a notification with a secure, time-limited download link. Large exports may be delivered in multiple parts.

5. Reversibility Guarantees

In accordance with the EU Data Act (Articles 23-25), Katoads ensures the following reversibility guarantees upon service termination:

• Grace period: 30 days after account closure to request a full data export. During this period, your data remains intact and accessible.
• Data deletion: After the 30-day grace period, all your data will be permanently and irreversibly deleted from our systems within 60 days, except where retention is required by law (e.g., tax records).
• Transition assistance: Upon request, we provide reasonable technical assistance to facilitate data migration to an alternative service provider.

6. Service Switching Provisions

Katoads does not impose contractual, technical, or commercial barriers to switching providers. There are no exit fees, data lock-in mechanisms, or proprietary format requirements. Your subscription can be canceled at any time via account settings. All generated content and data can be exported in standard formats before or after cancellation. We actively support your right to switch by providing data in interoperable formats and offering transition documentation.

7. Data Interoperability

We use open standards and widely-supported formats to maximize interoperability with other platforms. Generated images are standard PNG files, videos are MP4 (H.264), and all structured data (profiles, products, brands) is exported as UTF-8 encoded JSON with documented schemas. API access may be provided for programmatic data retrieval upon request for enterprise customers.

8. Response Timelines

• Acknowledgment of portability request: within 2 business days
• Delivery of exported data: within 15 business days of identity verification (30 days maximum per GDPR Article 12)
• Post-termination data retention for export: 30 days after account closure
